Terms of Use
1. About these Terms
These Terms of Use (“Terms”) govern your use of the RealtyTwin website and services at realtytwin.ai (the “Service”). RealtyTwin is operated by HCS Holdings, LLC. In these Terms, “RealtyTwin”, “we” and “us” refer to HCS Holdings, LLC as the operator of the Service.
By creating an account you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not create an account or use the account features of the Service.
2. What RealtyTwin is
RealtyTwin is informational and organizational software for residential properties. It lets you look up available information about a property and, with an account, keep a Home Profile for a residential property you own or co-own.
RealtyTwin is not a substitute for licensed legal, tax, insurance, lending, appraisal, engineering, architectural, contractor, inspection or real-estate brokerage advice or services, and it does not provide any of them. Consult a qualified professional before relying on any information from the Service for a decision in those areas.
3. Where the Service is available
The Service is designed for residential properties in the United States. If you are otherwise eligible, you may use it while you are travelling or temporarily living outside the United States, but only for eligible U.S. residential properties. We may restrict access from some locations where the law, our providers, sanctions or security require it.
4. Eligibility and accounts
- You must be at least 18 years old to create an account. When you activate your account you confirm that you are at least 18 years old.
- You are responsible for the accuracy of the information you give us, for keeping your sign-in credentials confidential and for activity under your account. Tell us promptly at admin@realtytwin.ai if you believe your account has been used without your permission.
- You may use the Service only for yourself; do not share your account or create an account for someone else.
- Accounts are for individuals (natural persons). In this version, RealtyTwin is not offered for property owned by a business entity, for acting on behalf of a business entity, for managing property owned by others, for organisational or multi-property portfolio use, or for commercial property.
5. Exploring a property and creating a Home Profile
- Explore a Property. Anyone, including people who do not own the property, may search for a property and view the information available for it, without creating a persistent Home Profile. Exploring a property does not imply that you own it.
- Home Profiles are for owners. Only an individual who actually owns or co-owns a U.S. residential property may create a Home Profile for that property. For this purpose you own or co-own a property if you hold it personally, alone or with others, or if it is held in your own revocable living trust and you have authority to create and maintain its Home Profile. Property held by a business entity (such as an LLC, corporation or partnership) or by any other kind of trust is not eligible in this version, and you are not eligible merely because you work for, manage, represent or provide services to the owner. You do not need to live in the property: a residential rental property you personally own is eligible. Each account may have one active Home Profile. When you create a Home Profile you must confirm: “I confirm that I own or co-own this property and am authorized to create and maintain its Home Profile.”
- We rely on your confirmation. RealtyTwin does not independently verify legal ownership and does not ask for deeds, identity documents, mortgage or insurance documents or similar proof. “My Home” is your designation. Do not create a Home Profile for a property you do not own or co-own.
- Creating a Home Profile for a prospective purchase is not currently offered.
- If a Home Profile was created without ownership. If we reasonably believe that a Home Profile was created by someone who does not own or co-own the property, we may act on that Home Profile: restrict access to it, require you to re-confirm ownership through the same confirmation (we do not ask for documents), archive it, or delete it where appropriate. We may use restriction or archiving before deletion where appropriate, and deletion follows section 10 and our Privacy Policy. In serious, fraudulent, repeated or abusive cases we may also act on your account under section 9. We give notice as described in section 9.
- We do not decide ownership disputes. We do not verify title, have no general duty to investigate property ownership, and do not decide between competing ownership claims. A Home Profile that is false or disputed does not prevent another owner or co-owner from creating their own separate Home Profile.
6. Property and provider information
Property information in the Service may come from third-party data providers, public records and other sources. It may be inaccurate, incomplete, out of date, estimated or unavailable. We show its source and when it was retrieved where we can, we show missing information as unknown or not available rather than guessing it, and we do not independently verify provider information. Estimated values are estimates, not appraisals.
7. Your content
- “Your content” means information and other material you add to the Service.
- You keep whatever rights you have in your content. You permit RealtyTwin to store, process, copy, display and transmit your content only as needed to provide the Service to you, operate and maintain it, keep it secure, give you support, and meet legal, security, fraud-prevention and abuse-prevention obligations, including through service providers that perform those functions for us.
- We do not use your content for any other purpose: not for unrelated secondary purposes, not for product-improvement datasets (including aggregated or de-identified datasets derived from your content), not to train artificial-intelligence or machine-learning models, and not for advertising or sale. If that ever changes, we will publish updated versions of these Terms and the Privacy Policy before the change applies.
- You must have the right to add the content you add. Do not add content that you are not allowed to share.
- Do not use the Service to store mortgage or insurance account information; the Service does not provide fields or features for it.
8. Acceptable use
You must not:
- create or keep a Home Profile for a property you do not own or co-own, or give false confirmations;
- access, or try to access, accounts, Home Profiles or other information you are not authorised to access, including by using links or addresses you were not given;
- interfere with the Service's security, rate limits or abuse protections, or use automated means to overload, scrape or misuse property lookups;
- use the Service in violation of applicable law;
- copy, scrape, bulk-extract, resell, redistribute or commercially republish property or provider information from the Service in a way these Terms or our data providers' terms do not permit; this does not limit your reasonable personal use, or an export, of your own property information;
- impersonate anyone, or knowingly submit another person's personal information without authority to do so;
- probe, scan or test the Service's security, circumvent its security or access controls, or introduce malicious code, without our written permission.
9. Suspension and closing your account
- You may ask to delete your account at any time; see section 10.
- Suspension or restriction. We may suspend or restrict your account only for cause: a material violation of these Terms; a false or materially misleading ownership confirmation; attempted or actual unauthorised access; fraud, abuse or intentional interference with the Service; unlawful use; a material security risk to RealtyTwin, our users, our service providers or others; or where the law requires it. Suspension or restriction does not by itself delete your account, your Home Profile or your data.
- Permanent closure. For the same reasons, we may permanently close your account. We do not close accounts merely for our convenience. When an account is permanently closed, its data is handled under section 10 and our Privacy Policy, and where it is lawful, safe and technically available we will give you an opportunity to obtain your eligible exportable data first.
- Notice. We will tell you in advance when that is reasonably possible and lawful. Where we need to act immediately — for security, to prevent abuse, to comply with the law or to protect others — we may act first and tell you afterwards when appropriate and lawful.
10. Exporting and deleting your data
You may request an export or deletion of your eligible private data. Deletion and export are subject to recovery periods, backups and our fraud, security and legal obligations, so we do not promise immediate or irreversible deletion where backups or recovery still apply. Provider information that we obtained independently, or that is shared with others, may remain only where it is no longer linked to you. Our Privacy Policy explains this further.
11. Changes to the Service
The Service is under active development. We may modify, improve, replace, suspend or discontinue individual features over time, and we do not guarantee uptime, a service level, or that any particular feature will remain available. This does not change how we treat your account, which section 9 covers. If we decide to discontinue the Service as a whole, we will give reasonable advance notice where practicable and lawful and, where it is lawful, safe, technically available and practicable, an opportunity to obtain your eligible exportable data first. Not every category of data may be exportable, and export may not be possible in every emergency or legal circumstance.
12. Changes to these Terms
These Terms have a version identifier, an effective date and a publication date. A change creates a new version; a published version is never edited. A version never takes effect before it is published: it may take effect on the day it is published, or we may publish it in advance with a later effective date. For a material change, we may ask you to accept the new version before you continue using account features; your earlier acceptance otherwise continues to apply. We record which version of these Terms and of the Privacy Policy you accepted and when.
13. Governing law
These Terms are governed by the laws of the State of Maryland, subject to any applicable law that cannot be waived.
14. Disclaimers and limitation of liability
The Service provides informational and organizational tools and content. Property information, values, estimates, projections, costs, possible effects of improvements, recommendations and any computer-generated output, including AI-generated output where the Service provides it, may be incomplete, approximate, delayed or inaccurate. The Service is not an appraisal, inspection, engineering, legal, tax, insurance, lending, financial or other professional service. Evaluate any important decision independently, with qualified professionals where appropriate.
To the extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. HCS Holdings, LLC does not warrant that the Service will be uninterrupted, timely, secure or error-free, or that information in it — including information from third-party data providers and public records — is accurate, complete or current.
To the extent permitted by applicable law, HCS Holdings, LLC will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or property value, arising out of or relating to the Service or these Terms, even if it has been told such damages are possible. To the extent permitted by applicable law, its total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid to HCS Holdings, LLC for the Service in the twelve months before the event giving rise to the claim and (b) one hundred U.S. dollars (US$100).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, or any right you have under applicable law that cannot be waived. Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you.
